These Terms of Use govern your access to and use of Fluent language-learning apps, including Fluent: German, Fluent: English, future Fluent language apps, and the website at thefluent.app. By using Fluent, you agree to these terms. If you do not agree, do not use the apps or website.
1. About Fluent
Fluent provides language-learning tools such as flashcards, pronunciation audio, quizzes, weak-word review, bookmarks, progress statistics, translation language support, and related educational content. Features may vary by app, language, platform, country, subscription status, and app version.
2. Eligibility
You may use Fluent only if you can form a legally binding agreement or if a parent or legal guardian has approved your use. Fluent is not directed to children under 13, or the minimum age required in your country to use digital services without parental consent.
3. License to Use the App
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Fluent for your own learning purposes. You may not copy, resell, reverse engineer, scrape, modify, distribute, or misuse the apps, website, audio, vocabulary data, translations, design, or other content except as allowed by law.
4. App Stores and Platform Terms
If you download Fluent through the Apple App Store or Google Play, the applicable store terms also apply. Those stores may process downloads, purchases, refunds, cancellations, taxes, and device-level permissions. If there is a conflict between these terms and mandatory app-store rules, the mandatory app-store rules apply for that platform.
5. Free and Paid Features
Fluent may offer free features and paid features such as Pro or Premium access. Paid plans, trial periods, prices, renewal dates, and cancellation options are shown before purchase in the relevant app store or payment flow. Unless stated otherwise, subscriptions renew automatically until cancelled. You are responsible for cancelling through the store account or platform where you purchased the subscription.
6. Learning Content
We work to keep vocabulary, translations, examples, audio, and grammar-related content useful and accurate, but language content may contain errors, omissions, regional differences, or interpretation differences. Fluent is an educational aid and does not guarantee fluency, exam results, employment outcomes, immigration outcomes, or any specific learning result.
7. Your Data and Device
Some Fluent features store learning progress, settings, bookmarks, known words, weak words, quiz results, and preferences on your device. You are responsible for your device, backups, app updates, and any data loss caused by deleting the app, resetting the device, changing platforms, or disabling backup features. See the Privacy Policy for more information.
8. Acceptable Use
You agree not to:
- use Fluent for unlawful, harmful, abusive, or deceptive activity;
- attempt to bypass subscription limits, security, or platform controls;
- extract, copy, or republish Fluent content at scale;
- interfere with app operation, website operation, or other users; or
- use Fluent in a way that infringes intellectual property or privacy rights.
9. Intellectual Property
Fluent, the Fluent name, app designs, website designs, vocabulary databases, translations, audio, text, graphics, logos, and software are owned by us or our licensors and are protected by intellectual property laws. You do not receive ownership rights by using the apps or website.
10. Future User Content
If a future version lets you add custom words, notes, lists, recordings, or other content, you remain responsible for what you add. You grant us the limited rights needed to store, display, sync, back up, process, and support that content for Fluent features you use.
11. Third-Party Services
Fluent may rely on app stores, operating systems, payment providers, hosting providers, analytics, crash reporting, customer support, email, or other third-party services. Their own terms and privacy policies may apply when you use those services.
12. Changes and Availability
We may update, suspend, remove, or change features, content, prices, supported languages, supported platforms, or these terms. We may also release separate Fluent apps for additional languages in the future. Continued use after a change means you accept the updated terms.
13. Disclaimer
Fluent is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation.
14. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, lost profits, lost learning progress, or loss of goodwill. Our total liability for any claim related to Fluent will be limited to the amount you paid for Fluent in the 12 months before the claim, or 50 USD if you paid nothing.
15. Termination
You may stop using Fluent at any time. We may suspend or terminate access if you violate these terms, misuse the service, create risk for us or others, or if we discontinue the relevant app or feature.
16. Governing Law
These terms are governed by the laws applicable to the Fluent app publisher identified in the relevant app-store listing or website operator information, unless mandatory consumer protection laws in your country require otherwise.
